These Terms and Conditions ("Terms") govern your access to and use of WePlay.Media’s mobile games, applications, websites (including www.weplay.media, https://championshipquest.com, https://motogpguru.com, www.fanpowering.com), and related services (collectively, the "Services") available on the Apple App Store, Google Play Store, and other platforms. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy, as well as our Promotion Terms and Conditions for any promotional activities. If you do not agree to these Terms, do not use the Services.

WePlay Media ("we," "us," or "our") reserves the right to update these Terms at our discretion. The most recent version will govern your use of the Services, and continued use after changes constitutes acceptance. For the purposes of these Terms, "you" refers to the user or, if applicable, the parent or legal guardian of a minor user.

1. Ownership

All content, including but not limited to games, applications, websites, graphics, audio, text, and software within the Services, is the exclusive property of WePlay Media or its licensors. All rights not expressly granted herein are reserved by WePlay Media. The Services may include offerings from www.weplay.media, https://championshipquest.com, https://motogpguru.com and www.fanpowering.com, which are also subject to these Terms.

2. Grant of Limited License

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Services for non-commercial, entertainment purposes only. This license includes playing our mobile games, content and service offered on www.fanpowering.com.

You acknowledge that virtual currency, coins, points, Tifo’s, Tifotix or in-game items ("Virtual Items") purchased or earned within the Services are part of this license and have no real-world monetary value. You may not sublicense, trade, sell, exchange, or transfer Virtual Items outside the Services. Any such attempt is void and may result in termination of your license and account. We reserve the right to suspend or terminate your access to the Services at our discretion, including for conduct violating these Terms.

3. Accessing the Services

To use certain features of the Services, you may need to create an account. You agree to provide accurate, current, and complete account information and to update it as necessary. Our Privacy Policy details how we handle your personal information.

You are responsible for providing all necessary equipment (e.g., mobile devices) and software to access the Services and for any associated costs, such as internet or mobile data fees. You must maintain the confidentiality of your account credentials and are liable for any activity under your account.

4. License Restrictions

Your license is subject to the following restrictions. Violation may result in suspension or termination of your account, with or without notice:

  • You must be at least 13 years old to create an account or use the Services.

  • Users aged 13–17 require parental or legal guardian consent to use the Services.

  • You must ensure that children under 13 do not access your account.

  • You may not create an account if previously banned from the Services.

  • You may not use the Services for advertising, soliciting, or sharing promotional content without our express permission.

  • Posting, transmitting, or distributing illegal, obscene, or offensive content is prohibited.

  • Harassing, threatening, bullying, or spamming other users is strictly forbidden.

  • Hate speech, discriminatory content, or impersonation of others is not permitted.

  • Using cheats, exploits, or unauthorized software to manipulate the Services is prohibited.

  • Selling, buying, trading, or transferring Virtual Items or accounts without our written consent is forbidden.

  • You may not use any intellectual property from the Services except as expressly permitted.

  • Failure to comply with these Terms, the Privacy Policy, or the Promotion Terms and Conditions may result in termination.

5. Purchase Policy

The Services may offer in-app purchases of Virtual Items using real-world currency. These purchases grant a limited license to use Virtual Items within the Services and have no real-world value. All sales are final, and no refunds will be provided, including in cases of account termination or service discontinuation.

You agree that transactions may be conducted electronically, and you are responsible for all fees and taxes associated with your purchases, regardless of who initiates them under your account. To prevent unauthorized purchases, keep your account credentials secure.

The Services are not intended for use by children under 13. If you are a parent or guardian, you are responsible for any purchases made by minors using your account or payment methods. We recommend supervising minors to prevent unauthorized in-app purchases.

WePlay Media is not liable for purchase errors, billing issues, or compatibility problems with your device or platform (e.g., Apple or Google). You are responsible for verifying compatibility before downloading or purchasing. No refunds or returns are offered for software downloads or Virtual Items.

6. Compliance with Laws

You agree to comply with all applicable federal, state, local, and international laws, regulations, and rules when using the Services. You also agree to respect the rights of other users and third parties.

7. User Content

You are solely responsible for any content you post, upload, or transmit through the Services, including text, images, or other materials ("User Content"). By posting User Content, you grant WePlay Media a non-exclusive, royalty-free, fully paid, transferable, sub-licensable, worldwide license to use, display, reproduce, and distribute such content in connection with the Services.

You represent that you own or have the necessary rights to post User Content and that it does not violate any third-party rights, including privacy, publicity, copyright, or trademark rights. You agree not to post content that is unlawful, offensive, discriminatory, or sexually explicit. WePlay Media may, but is not obligated to, monitor or remove User Content at our discretion without notice.

We are not responsible for User Content that may be offensive or objectionable. If you are a repeat infringer of intellectual property or other rights, we may terminate your account without notice.

8. User Interactions

You are expected to interact with other users respectfully. Prohibited actions include:

  • Impersonating, harassing, or bullying other users.

  • Sharing private or confidential information about others.

  • Sending unsolicited commercial or harassing communications.

You are solely responsible for your interactions with other users. WePlay Media is not liable for user conduct but reserves the right to monitor interactions and intervene to prevent disputes or harmful behavior.

9. Third-Party Advertising and Links

The Services may include advertisements or links to third-party websites or services. WePlay Media does not endorse or control these third parties and is not responsible for their content, practices, or any obligations arising from your interactions with them. You engage with third parties at your own risk.

10. Updates to Services

WePlay Media may update the Services, including MotoGP Guru games and www.fanpowering.com features, at any time, with or without notice. You agree to accept updates to continue using the Services. Failure to update may result in limited or no access to certain features.

11. Disclaimer of Warranties

THE SERVICES, INCLUDING VIRTUAL ITEMS AND WWW.FANPOWERING.COM OFFERINGS, ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, EXCEPT AS REQUIRED BY APPLICABLE LAW.

WEPLAY MEDIA DOES NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEPLAY MEDIA, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR PRIVACY, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICES IS TO STOP USING THEM AND CANCEL YOUR ACCOUNT. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICES IN THE PRECEDING 180 DAYS, IF ANY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THESE MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold WePlay Media, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, liabilities, damages, or expenses (including legal fees) arising from your use or misuse of the Services, violation of these Terms, or infringement of any third-party rights. This obligation survives termination of your use of the Services.

14. Dispute Resolution

If you have concerns about the Services, please contact us at support@weplaymedia.com. If we cannot resolve your issue, disputes arising from these Terms or your use of the Services will be resolved through binding, individual arbitration under the American Arbitration Association’s Consumer Arbitration Rules. You and WePlay Media waive the right to a jury trial or class action. Alternatively, you may bring claims in your local small claims court, if permitted.

Arbitration will be conducted in English, and the arbitrator’s decision will be final, except as provided by law. You may only bring claims on your own behalf, not as part of a class or representative action.

15. Governing Law

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict of law principles. Any legal action not subject to arbitration will be brought exclusively in the federal or state courts located in Phoenix, Arizona, and you consent to their jurisdiction.

16. General Provisions

These Terms, together with the Privacy Policy and  Promotion Terms and Conditions, constitute the entire agreement between you and WePlay Media, superseding any prior agreements. If any provision is found invalid, the remaining provisions remain enforceable.

WePlay Media’s failure to enforce any right or provision does not waive that right. We may assign these Terms to any party without your consent. You may not assign your rights or obligations without our prior written consent. WePlay Media is not liable for delays or failures due to causes beyond our reasonable control, such as natural disasters or technical outages.
